The general terms and conditions of sale described below set out the rights and obligations of the company SARL Claude & Robert Héritiers and its client in connection with the sale of the following goods: Wines.
Any service performed by the company SARL Claude & Robert Héritiers therefore implies the unreserved acceptance of the buyer to these general terms and conditions of sale.
The prices of the goods sold are those in effect on the day the order is placed. They are expressed in euros and calculated excluding taxes, ex-cellar. Consequently, they will be increased by the VAT rate and transport costs (if applicable) applicable on the day of the order.
The company SARL Claude & Robert Héritiers reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated upon registration of the order.
The prices offered include any discounts and rebates that SARL Claude & Robert Héritiers may grant based on its results or the assumption of certain services by the buyer.
The prices offered include any marketing events or promotions that SARL Claude & Robert Héritiers may grant specifically under the rates revised annually.
No discount will be granted for early payment.
Payment for orders is made:
By bank transfer or under special conditions stated on the front of the invoice or in the contract. The buyer must pay the total amount of the invoice by the due date specified on the front of the invoice.
In the event of total or partial non-payment of the goods delivered on the date of receipt, the buyer must pay SARL Claude & Robert Héritiers a late payment penalty equal to three times the legal interest rate.
The legal interest rate applied is the one in force on the day the goods are delivered, as stated on the front of the invoice.
Wine is a "living" product provided by nature in variable quantities depending on the vintage year.
Retention of title: the goods remain our property until payment is made in full (Law 80.835 of May 12, 1980). We retain full ownership of the goods until full payment of the price, delivery costs, packaging, and taxes. In the same manner as for all our general terms and conditions of sale, ordering a product listed on the site implies the unconditional acceptance of this retention of title clause by the buyer. The customer undertakes to notify us immediately, under penalty of damages, of any seizure performed by a third party. The customer undertakes to allow us to repossess our goods without prior notice, to authorize us to enter the premises, and to bear the costs of removing our goods. In the event of non-payment by the due date, whether full or partial, SARL Claude & Robert Héritiers may, without formal notice
Any claim regarding the supplied goods must reach us by registered letter within five days of receipt, referring to the numbers and date of the purchase invoice (or failing that, the delivery note), the product reference and quantity, and setting out the reasons for the claim. After this period, claims will no longer be considered. No returns of goods will be accepted without our prior written consent, and provided they are returned to us in brand-new condition and in their original packaging. In any case, returns accepted by SARL Claude & Robert Héritiers will be subject to a credit note at the price rate in effect on the day of delivery. Any claims regarding our invoices must be brought to our attention by registered letter within ten days of receipt. Failing this, they will be considered accepted without reservation. Incomplete fulfillment of an order cannot justify refusal to pay for delivered goods. Partial invoices may also be issued as goods are supplied. Payment of invoices can never be conditional upon the complete delivery of the order.
Our general terms and conditions of sale, as well as our special conditions, are deemed to be irrevocably accepted by the buyer. All sales operations between SARL Claude & Robert Héritiers and the buyer are therefore subject to our conditions below, notwithstanding any contrary stipulation that may appear on the buyer's purchase orders.

Protection of Minors and Legal Capacity
In accordance with Article L. 3342-1 of the French Public Health Code prohibiting the sale of alcohol to minors under the age of 18, the Client declares to be at least 18 years old and to have the legal capacity to place an order on the Site.

Alcohol abuse is dangerous for health; consume in moderation.
Alcohol should not be consumed by pregnant women.
